The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.235 dated 2.11.2016 registered for the offences under Sections 285, 392, 412 and 120-B IPC and Section 25 of the Arms Act at Police Station Siwani, District Bhiwani. I have heard learned counsel for the petitioner and have gone through the record.
As per the FIR, Satish Kumar-complainant was running a Reliance Pump at Siwani. He had come to him for looking after the pump. He and his brother Bhagwan Dass were counting the cash when three young boys came there on white colour bike and a sticker was pasted on the number plate. Two boys came inside and fired a shot from pistol and the other one who was having a bag and also armed with a country made pistol, collected the money i.e. `4,28,370/- and put in the bag and the third boy Harpal Singh Parmar 2017.03.17 16:56 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-9026 of 2017 [2] snatched all the bags from outside in which `40,000/- was there. A mobile was also snatched from an Innova car customer. Keeping in view the facts and circumstances of the present case, nature and gravity of the offences, I do not find it a fit case where the present petitioner is entitled to the benefit of anticipatory bail. Therefore, finding no merit in this petition, the same is dismissed.
