The present petition has been filed under Section 528 BNSS, 2023 (corresponding to Section 482 Cr.P.C.) seeking grant of interim bail to the petitioner in case FIR No. 14 dated 19.09.2025, registered under Sections 111, 318(4) and 61(2) of the BNS (corresponding to Sections 420 and 120-B IPC), Sections 66(C) and 66(D) of the Information Technology Act and Sections 237, 238, 336(3) and 340 of the BNS (corresponding to Sections 200, 201, 468 and 470 IPC), added later on, at Police Station Cyber Crime, Kapurthala, on medical grounds on the plea that the petitioner requires immediate medical attention.

Learned counsel for the petitioner has argued that the petitioner is seeking grant of interim bail on medical grounds as he is suffering from a
severe and rapidly deteriorating medical condition requiring urgent, continuous and specialized medical treatment. It is submitted that the petitioner is acutely suffering from "Black Jaundice" and has also recently experienced alarming symptoms including active bleeding from the rectum. Learned counsel submits that the liver function tests of the petitioner are highly deranged and the AST (SGOT) levels are abnormally elevated, clearly indicating deterioration in his medical condition. It is further argued that the jail dispensary is not properly equipped to handle such acute medical emergencies and lacks specialized gastroenterology and hepatology facilities, continuous monitoring and advanced diagnostic procedures such as endoscopy/colonoscopy, which are immediately required for proper treatment of the petitioner.
It is further submitted that although the petitioner has repeatedly been taken to the hospital by the jail authorities, no proper and definitive treatment is being provided to him and only rudimentary and palliative care is being administered. Learned counsel has further argued that denial of proper and specialized medical treatment to the petitioner would seriously endanger his life and health and would amount to violation of his fundamental right guaranteed under Article 21 of the Constitution of India. Learned counsel has also submitted that the petitioner had earlier filed a petition for grant of regular bail bearing CRM-M-402 of 2026, which was dismissed as withdrawn vide order dated 20.03.2026. It is further argued that similarly situated co-accused have already been granted regular bail by this Hon'ble Court vide order dated 12.03.

Learned State counsel has submitted that the State is making sincere efforts to comply with the orders passed by this Court regarding the medical condition and treatment of the petitioner. It is submitted that initially the medical examination of the petitioner was conducted in the jail hospital at Central Jail, Kapurthala and thereafter, in compliance with the orders passed by this Court, the petitioner was referred to Civil Hospital, Kapurthala for further examination and treatment. Learned State counsel has further submitted that the petitioner was examined by the Medical Officer, Civil Hospital, Kapurthala and as per the medical status report, all the findings of the petitioner were found to be normal.
It has been submitted that ECG of the petitioner was also conducted and the petitioner was found conscious, oriented and medically stable with GCS 15/15 and no fresh complaint was noticed. It is further submitted that the petitioner has also been called for follow-up treatment in the Medicine OPD of Civil Hospital, Kapurthala and all necessary medical care is being extended to him in accordance with law.

I have heard learned counsel for the parties and perused the record carefully.

The grievance raised by the petitioner in the present petition is that he is suffering from "Black Jaundice" and requires urgent and specialized medical treatment and on the said ground, concession of interim bail has been sought. Keeping in view the said allegations, this Court had
directed the respondents to submit the medical status report of the petitioner. Pursuant thereto, medical report from the Superintendent, Central Jail, Kapurthala was produced on record, which reveals that the petitioner was medically examined and thereafter referred to Civil Hospital, Kapurthala for further treatment and medical evaluation. The medical status report submitted by Civil Hospital, Kapurthala further reveals that ECG of the petitioner was conducted and all findings were found normal and the petitioner was conscious, cooperative, oriented and medically stable. 6.
During the course of hearing, learned counsel for the petitioner has submitted that the petitioner would be satisfied in case he is permitted to get himself treated from a private hospital at his own expenses. Learned State counsel, upon instructions, has submitted that the State has no objection in case the petitioner is taken to a private hospital for treatment at his own expenses.

Accordingly, Superintendent, Central Jail, Kapurthala is directed to take the petitioner to a reputed private hospital at Kapurthala for his proper medical examination and treatment at the expenses of the petitioner. In case the concerned private hospital refers the petitioner to any higher medical centre or any other specialized hospital, the Superintendent, Central Jail, Kapurthala shall ensure compliance of such referral so that the petitioner is provided necessary and proper medical treatment in accordance with law at the expenses of the petitioner.

In view of the aforesaid directions and the fact that proper medical treatment is available to the petitioner, no ground is made out for grant of concession of interim bail to the petitioner. 9.
Accordingly, the present petition stands disposed of. 10.
