This is third petition under section 438 Cr.P.C. seeking anticipatory bail in a case registered against the petitioner under sections 307, 323, 341, 506, 148 & 149 IPC at police station Islamabad, District Amritsar on the complaint of one Deepak Kumar, He stated that on 30.01.2012 petitioner alongwith co-accused assaulted his father and inflicted injuries on him. He was admitted to Amandeep hospital in a serious condition. FIR was registered on 30.01.2012. Petitioner, thereafter, moved anticipatory bail application before this court which was dismissed as withdrawn on 01.05.2012. Thereafter, another petition of similar nature was moved before this court. Same was disposed of on January 09, 2014. Operative part whereof reads as under:- "In view of above, this petition is disposed of with a direction that in case petitioner surrenders before the court below within 10 days from today and moves an application for bail, same shall be decided within a week thereafter. CRM M-9032 of 2017 Arrest of the petitioner shall remain stayed till the decision of the bail application."

It is evident that petitioner was given the liberty to move petition for regular bail before the court below and his arrest was stayed meanwhile. Admittedly, petitioner never availed of this concession given by the court. The third petition for same relief is mis-conceived particularly keeping in view the conduct of the petitioner. Dismissed.
