DAILY LOK ADALAT BENCH NO.3 FAO-3305-2007 MANDEEP SINGH VS GENERAL MANAGER & ANR * * * *

Present:

Mr. Vishal Aggarwal, Advocate for the appellant. Mr. Sukhvir Singh, General Manager and Mr. Ravi Kumar, Law Officer, Punjab Roadways, Pathankot. * * * * A proposal was drawn on 20.12.2017 wherein learned counsel for the claimant/appellant had sought an enhancement of Rs.5,00,000/- over and above the amount already awarded. A proposal was sent to Law Officer, Punjab Roadways, Pathankot through Assistant Advocate General, Punjab. Mr. Ravi Kumar, Law Officer has placed on record an attested copy of the order of the Principal Secretary to Govt. of Punjab, Department of Transport whereby the proposal has been accepted as drawn. The statement of Law Officer as also of the General Manager, Pathankot has been recorded and which has been duly signed by them.

In view of the agreement, as per the statements of learned counsel for the appellant as well as the representatives of the State Government separately recorded, a sum of Rs.5,00,000/- (Rupees Five Lakh only) ) over and above the amount already awarded by the Tribunal is allowed to the appellant in full and final settlement of the claim. As per the statement of learned counsel for the appellant, the enhanced amount be paid to the appellant-Mandeep Singh S/o Sh. Karnail Singh. Accordingly, we dispose of this case with a direction to the respondent department to deposit cheque for Rs.5,00,000/- (Rupees Five Lakh Only) favouring appellant- Mandeep Singh S/o Sh. Karnail Singh with the Office of the Lok Adalat of the High Court on or before 21.05.2018. Failing compliance of the order, interest @ 9% per annum shall follow on NISHA 2018.03.

-2this amount till payment from the date of this order. The appellant's counsel may collect the cheque from the office of the Lok Adalat after retaining the photocopy of the cheque/draft bearing signatures of the Counsel.

Appeal stands disposed of.
