This petition has been filed for quashing of order dated 5.3.2019, whereby charges have been framed in case State v. Madan Jha etc., arising out of FIR No. 33 dated 18.4.2018 under Sections 354-D, 509 and 109 IPC registered at Women Police Station, Rewari, pending in the Court of JMIC, Rewari.

Learned State counsel has filed status report dated 24.3.2023, which is taken on record.

On the basis of status report, it is submitted by the learned State counsel that the matter was duly investigated. A pen drive as well as mobile phone of the accused were taken into possession, and call details along with certificate under Section 65-B of the Indian Evidence Act were obtained from the subscriber. On verification, it was found that all the persons were connected to each other and accused Mamta Jha/petitioner no.2 made calls from mobile number 9050546553, of a person known to her, namely, Avdash Tyagi, to the ASHWANI KUMAR 2023.03.29 17:51 I attest to the accuracy and integrity of this document

CRM-M No. 25086 of 2019 -2- 2023:PHHC:044802 complainant on 10.3.2018. Avdash Tyagi has been declared a proclaimed offender.

Learned counsel further submits that after framing of charges against the petitioners, trial of the case is going on, and one of the prosecution witnesses has already been examined.

In view thereof, there is no ground to entertain the petition. 6.

Dismissed.
