(Oral) This petition under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No.53 dated 03.02.2018, under Sections 22-C,27-A/61/85 of NDPS Act, 18-A/18-C of Drugs and Cosmetics Act registered at Police Station Sadar Fatehabad, District Fatehabad. Learned counsel for the petitioner submits that earlier also the petitioner filed CRM-M-25346-2018 and 42035-2018 for grant of regular bail to the petitioner and the same were dismissed, vide orders dated 16.07.2018 and 15.01.2019 (P-2 and P-3 respectively) Further learned counsel states that the co-accused Deepak Kumar has already been granted regular bail by this Court, vide CRM-M-10065-2020, decided on 19.08.2020.

Learned State counsel has not disputed the above fact. The petitioner is in custody since 03.02.2018 GAURAV ARORA 2020.10.29 11:51 I attest to the accuracy and integrity of this document Chandigarh Heard.

CRM No. M-26486 of 2020 -2Keeping in view the COVID 19 situation and the fact that trial will take some time for its conclusion, this court feels that there is no need to detain the petitioner any longer. Accordingly, this petition is allowed and petitioner is ordered to be enlarged on bail, subject to his furnishing bail bonds/surety bonds to the satisfaction of the trial Court/Duty Magistrate, Fatehabad.
