Prayer in the present writ petition filed under Articles 226/227 of the Constitution of India is for setting aside the impugned order dated 16.03.2026 (Annexure P-12) whereby the Assistant Collector 1st Grade, Mahendragarh, instead of adjudicating upon the application filed under Section 7 of the Haryana Village Common Lands (Regulation) Act, 1961, has disposed off the matter only by directing the Block Development and Panchayat Officer, Kanina to inspect the site and ensure that appropriate action is taken.

On advance notice, Mr. Saurabh Mago, DAG Haryana has put in appearance on behalf of respondent Nos.1 to 4/State and he on instructions states that the impugned order dated 16.03.2026 (Annexure P-12) is not legally sustainable and that the same may be set aside and the matter be remanded to the Assistant Collector 1st Grade, Mahendragarh for a decision afresh, in accordance with law.

In view of the above, the present writ petition is allowed and the YOGESH SHARMA 2026.05.07 10:15 I attest to the accuracy and authenticity of this order/judgment.

CWP-14058-2026 (O&M) impugned order dated 16.03.2026 (Annexure P-12) is set aside without commenting on the merits of the case. The Assistant Collector 1st Grade, Mahendragarh is directed to expeditiously decide the matter afresh, in accordance with law.
