**** ANITA CHAUDHRY, J The petitioner is seeking regular bail in FIR No. 99 dated 1.12.2017 registered at Police Station Joga, District Mansa under Sections 363, 366-A, 120-B IPC with enhanced offences under Section 376 IPC and Section 5, 6 and 11 of Protection of Children from Sexual Offences Act, 2012.

Counsel for the petitioner contends that investigation is over and the petitioner is in custody since 6.12.2017 and it was a case of run away marriage and the boy and girl had approached the Court for protection on 28.11.2017 and protection was granted and the counsel refers to Annexure P-1. He further submits that they had told the Court their intentions that they wanted to get married and have placed on record photograph to show that they got married two days later in the Gurudwara. The counsel further submits that the girl is major and places on record photocopy of verification of Aadhar Card.

Crl. Misc. No. M-6015 of 2018 -2State counsel submits that the girl is a minor and they have collected evidence to show that her date of birth is different and was born in the year 2000. State counsel informs that challan is shortly being filed. According to the Aadhar Card, the girl is major. The investigation is over.

Without commenting anything on the merits of the case and considering the fact that the trial will take time to conclude, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing local surety and adequate bonds to the satisfaction of the trial Court/Duty Magistrate with the condition that the petitioner would not contact the victim during trial.
