Mr. Tanuj Sharma, AAG, Haryana **** ANITA CHAUDHRY, J The petitioner is seeking regular bail in FIR No. 0247 dated 17.6.2017 registered at Police Station City Tohana, District Fatehabad under Sections 376(2) N, 506 IPC.
Counsel for the petitioner contends that the complainant is around 50 years old and is a widow and she had refused her medical and has levelled allegations under Section 376 IPC. The counsel further submits that before the panchayat she had made a statement and it was a case of consent and she was in a relationship with the petitioner for more than a decade and the petitioner is in custody since 8.7.2017 and challan has been presented and trial would take time.
Investigation is over. Challan has been presented. The victim had refused her medical examination.
