Today the case is fixed for arguments but none has appeared for the petitioner.

I have perused the paper-book and proceed to decide the petition on merits.

This is revision petition filed by Satish Kumar against order dated 10.03.2014 passed by Sub Divisional Judicial Magistrate, Ratia whereby respondents on their conviction for offences punishable under Sections 148, 323 and 506 read with Section 149 of Indian Penal Code (for short 'IPC') were released on furnishing probation bond in a sum of `20,000/- with one surety in the like amount each. Learned Magistrate while allowing the benefit of probation to convicts-respondents had taken into account this fact that it was a cross case between the parties, who have a dispute regarding demolishing a water course. The parties are also resident of same village and learned Magistrate was of the view that they should be allowed an opportunity to solve the dispute between them and to maintain peace and harmony. Keeping in view the nature of offence, I find no reason to interfere with the view taken by learned trial Court while affording the benefit of probation to private respondents.
