Gurmej Kaur v. Karnail Singh & ANR
CRR No. 3643 of 2016 (O&M)
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH CRR No. 3643 of 2016 (O&M) DATE OF DECISION :- February 09, 2018 Gurmej Kaur
...Petitioner
Versus
Karnail Singh and another
...Respondents
CORAM:
HON'BLE MR. JUSTICE H.S. MADAAN Present:- None for the petitioner.
*** There is no one to represent the Revision-petitioner. Similar was the position on the last date of hearing. The Revision-petitioner is aggrieved by the judgment passed by Chief Judicial Magistrate, Fazilka vide which Karnail Singh and his wife Balwinder Kaur were acquitted of the charge framed against them as well as the judgment dated 16.7.2015 passed by Additional Sessions Judge, Fazilka dismissing the appeal. The petitioner has approached this Court belatedly by 331 days. Though an application under Section 5 of the Limitation Act for condonation of delay has been filed giving the reasoning that the delay took place on account of wrong legal advice, but I do not find such reason to be cogent and convincing. There is no justifiable ground to condone the delay as asked for in the application, therefore, the application stands dismissed. The RevisionPetition is therefore liable to be dismissed being barred by time. Parvinder Singh 2018.02.14 15:55 I attest to the accuracy and integrity of this document Chandigarh
CRR No. 3643 of 2016 (O&M) On merits also the Revision-petitioner does not have any case. I have gone through the judgments passed by the Courts below and I do not find any illegality or infirmity there with, much less apparent on the fact of such judgments. There is no ground to interfere with the impugned judgments while exercising the revisional jurisdiction. As such, the Criminal Revision Petition stands dismissed.
