VINOD S. BHARDWAJ , J (ORAL) Prayer in the instant writ petition is for issuance of a writ in the nature of Mandamus directing the respondents to consider the petitioners for promotion to the posts of Water Pump Operator, Grade-I in terms of Memo dated 17.02.2022 against 71 vacant posts.

Upon notice, written statement has been filed by Jaswant Singh, Superintending Engineer, Public Health Engineering Circle, Sirsa wherein it has been averred that out of total 37 petitioners, 26 have already been promoted while one of the petitioners i.e Baljeet Singh (petitioner at Sr.No.20) resigned from the post of W.P.O Grand-II on 08.08.2023. It is further averred in the reply that remaining 10 petitioners would be promoted as and when the posts become vacant in future, as per the seniority list.

Learned counsel for the petitioners does not dispute the aforesaid factual position and thus submits that the present petition may be disposed of as having been rendered infructuous.

Ordered accordingly.

Respondents shall ensure that the averments contained in para 5 of the reply are strictly adhered to as and when any vacancy arises.
