**** HARSIMRAN SINGH SETHI , J. (ORAL) In the present writ petition, the grievance which is being raised by the petitioner is that his wife was suffering from many ailments, was treated at various Hospitals and in this regard he has incurred a sum of `14,87,158/-.
Counsel for the petitioner argues that after the treatment, the bills were submitted for reimbursement and after considering all the relevant documents, the respondents vide orders dated 17.07.2018 (Annexure P-1) and 06.08.2018 (Annexure P-2) approved a sum of `10,04,442/- and another sum of `82,816/- to be paid to the petitioner as medical reimbursement. Counsel further argues that despite the fact that entitlement of the petitioner has been approved, but the payments of the NARESH KUMAR 2019.07.24 11:51 I attest to the accuracy and integrity of this document Chandigarh
CWP-19180-2019 -2said amount has not been made to him without any valid justification and the prayer in the present writ petition is for the issuance of direction to the respondents to release of the said amount to the petitioner immediately. Counsel for the petitioner states that for the relief which has been sought in the present writ petition, petitioner has served the respondents with a legal notice on 24.01.2019 (Annexure P-3), which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice.
In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 24.01.2019 (Annexure P-3) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of next two months.
Present writ petition stands disposed of.
