The petitioner seeks quashing of orders dated 01.10.2012 (Annexure P-11) order dated 30.04.2013 (Annexure P-12) and order dated 03.10.2012 (Annexure P-13) passed by the respondents vide which the benefit of deemed date appointment as Constable has been withdrawn from the petitioners. The petitioners are working as Senior Police Constables. At the outset, it is contended that before passing the impugned orders withdrawing the benefit of deemed date appointment, no show cause has been served upon the petitioners. Learned State counsel has not refuted the aforesaid factual aspect of the matter.

In view of above, the present petition is allowed. The impugned orders 01.10.2012 (Annexure P-11), order dated SANJAY 2019.01.11 17:02 I attest to the accuracy and integrity of this document

CWP No. 10552 of 2013.

30.04.2013 (Annexure P-12) and order dated 03.10.2012 (Annexure P13) passed by the respondents are hereby set aside. However, the respondents are at liberty to initiate proceedings afresh after adopting proper procedure of law.
