Learned counsel for petitioner argued that allegations levelled against petitioner are false and without any basis. No offence under Section 80 of BNS 2023 was made out. Their marriage was simple and there was no demand or acceptance of dowry. Prior to this no complaint was filed against the petitioner. In fact the deceased was unhappy with the marriage as the marriage was performed under the pressure of her parents. Petitioner was arrested in this case on 16.07.2024 and since then he is behind the bars. Petitioner is ready to abide by the terms of bail order. Therefore, his regular bail petition may be allowed.

On the other hand, learned counsel representing State filed status report along with custody certificate of the petitioner confirming the facts narrated in the FIR. It is pointed out that it is a case of unnatural death. After completion of investigation, challan is presented on 14.10.2024. After passing of commitment order, charges were framed on 16.01.2025. Recording of prosecution evidence is yet to start. Considering the gravity of offence, petitioner is not entitled to be released on regular bail. 5.

I have considered the aforesaid factual position and have gone through the record carefully. The marriage of deceased victim took place with petitioner/accused Bhupindra Singh about 3-4 months ago and on

15.07.2024, the victim ended her life by hanging herself with a ceiling fan. The FIR is lodged on the statement of father of the victim who has levelled specific allegations against the petitioner for giving beating and causing harassment to her on account of demand for a vehicle. It is a case of unnatural death. The trial is at initial stage. Statement of complainant is yet to be recorded. Considering the aforesaid factual position, at this stage, I do not find a fit case for grant of regular bail and the same is accordingly declined.
