Prayer in this petition, filed under Section 482 of the BNSS, 2023 (earlier Section 438 Cr.P.C.), is for grant of anticipatory bail to the petitioner, who has been booked in a criminal case arising out of First Information Report, as detailed hereunder:- Name & age of Petitioner FIR Date Section(s) Police Station District No.

On 01.05.2026, following order was passed by this Court:- "1.

On oral request, complainant namely Satnam Singh Devgan, son of Dalip Singh, resident of Patti Gurdas Ki, village Dhalleke, Tehsil and District

-2Moga (mobile No.96460-95005), is hereby ordered to be impleaded as respondent No.2 in the present petition.

Let amended memo of parties be filed by counsel for the petitioner in the Registry, within a period of two working days from today, without moving any separate application.

As per the allegations in the FIR, between May 2023 and August 2023, complainant allegedly paid a sum of Rs.12,20,000/- to the petitioner for facilitating travel to New Zealand, after the total consideration was settled at Rs.24,00,000/-. It is alleged that neither the amount has been refunded nor the complainant has been sent to New Zealand. Thus, petitioner is accused of having cheated the complainant.

Learned counsel for the petitioner contends that petitioner had received an amount of Rs.2,00,000/- in his bank account, which has since been returned to the complainant. It is further submitted that petitioner is willing to pay an additional amount to amicably resolve the dispute with the complainant. Thus, counsel prays for grant of anticipatory bail to the petitioner in the present case. 4.

Notice of motion.

On advance notice, Mr. Neeraj Madaan, Sr. DAG, Punjab, puts in appearance on behalf of the respondent - State, and seeks some time to file status report in the matter.

Let notice be issued to the newly added respondent No.2/complainant for 18.05.2026.

Meanwhile, petitioner shall not be arrested. However, issue of joining of investigation by the petitioner would be examined on the next date of hearing, after reviewing the status report, which is yet to be filed by learned State counsel."

Today, learned counsel for the petitioner, as well as learned counsel for respondent No.2 (while submitting her vakalatnama, which is taken on record), jointly submit that the parties have now entered into a compromise and the dispute inter se them stands resolved. 4.

In view of the stand taken by both the parties that compromise has been effected between the petitioner and respondent No.2, this Court does not deem it necessary to keep the present petition

-3pending any further and, accordingly, deems it appropriate to dispose of the same, with the direction to the petitioner to join the investigation within two weeks from today or as and when called by the investigating officer, and in the eventuality of the arrest, petitioner would be released on anticipatory bail, subject to her furnishing bail bonds to the satisfaction of the Arresting Officer. The petitioner shall also be abide by all the conditions laid down under Section 482(2) of BNSS, 2023 (earlier Section 438(2) Cr.P.C.).

Besides, it is directed that petitioner would hand over her passport to the Investigating Agency or to Court concerned, if she possesses. Otherwise, would submit an affidavit, disclosing the fact that she does not possess any passport.

It is also directed that before leaving country any time during trial, petitioner would seek prior permission of the Court. 12.

With the directions recorded here above, present petition stands disposed of.
