Petitioners have filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in criminal appeal No.472 of 2016 titled as 'Parmod Kaushal vs. M/s Indo Swift' pending in the Court of learned Addl. Sessions Judge, Chandigarh.

Notice of motion was issued. Learned Addl. Public Prosecutor for U.T. Chandigarh appeared and contested the petition. I have heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for U.T. Chandigarh and have gone through the record.

From the record, I find that the present petitioners have absented during the pendency of the appeal on 06.12.2106. In the order Vineet Gulati 2017.05.01 10:21 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-9209 of 2017 -2dated 10.03.2017 passed by learned Addl. Sessions Judge, Chandigarh, it is stated that applicants also filed application for personal exemption, which was dismissed by the Court.

The decision of the appeal will take long time. The petitioners have already appeared before the Court below and have been released on interim bail in pursuance of the order passed by this Court. No useful purpose will be served by sending the petitioners to custody. Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioners are entitled to benefit of grant of anticipatory bail. Therefore, the present petition is accepted and the order dated 17.03.2017 granting interim bail to the petitioners is made absolute.
