(Oral) This is a petition filed under Section 439 of the Code of Criminal Procedure seeking regular bail in a case registered against the petitioner vide FIR No.435 dated 25.10.2017 under Sections 307/34 IPC and Section 25/54/59 of Arms Act, at Police Station Kurukshetra University, District Kurukshetra.
Learned counsel for the petitioner has emphatically submitted that no role has been attributed to the petitioner. Only allegation against him is that he was a pillion rider on the motor cycle being driven by Mukesh. Learned State counsel on instructions from ASI Vijender Singh, submits that three persons were seated on the motor cycle. Out of them Shamsher Singh fired 02 shots at the complainant. One shot hit left arm of the complainant. Recovery of a country-made pistol was also effected from the petitioner. He is stated to have been convicted in two cases 174-A IPC. In view of same, in case, petitioner is granted concession of bail, possibility of his absconding can be ruled out. Dismissed.
