AMOL RATTAN SINGH, J (ORAL) Learned senior counsel appearing for the petitioner submits that as a matter of fact, the complainant, Nisha, turned hostile after she had testified on 05.2.2018. Learned State counsel does not dispute the factual position.
That being so and the petitioner having been shown to be acquitted in both the other cases registered against him earlier as per the judgments Annexures P.4 and P.5 (annexed with the petition), this petition is allowed and the petitioner is ordered to be admitted to bail upon his furnishing adequate bail bonds and surety bonds to the satisfaction of the learned trial Court.
