***** ARUN MONGA, J (ORAL) Petitioner having remained unsuccessful after participating in the selection process followed by interview for the post of District Programme Manager has impugned the office order dated 12.09.2018 (Annexure P-10) whereby he was declined the promotion on the said post. 2.

An affidavit dated 19.04.2021 has been filed by learned State counsel,wherein following stand has been taken:- XXX XXX "However, so far as grievance of present petitioner is concerned, it is submitted that he is working on the post of District Monitoring Evaluation Officer and now putting his claim against the vacant post of District Programme Manager. Both the posts are altogether on different pedestal, their TOR (terms of Recruitment) and jobs responsibilities are entirely different and cannot equated with each other.

5. That it would also be pertinent to mention here that during pendency of instant civil writ petition, an advertisement was issued by District Health and Family Welfare Society, Panipat, whereby applications were VANDANA 2022.04.28 01:51 I attest to the accuracy and integrity of this document

invited to fill up the vacant post of District Programme Manager. In pursuant to the same, the petitioner had also applied for the said post. However, petitioner has not been able to get breakthrough in the recruitment process. Therefore, once he has not been successful to get selected and appointed qua the said post, then in that eventuality,he cannot put forth his claim for promotion for the post in question."

The aforesaid stand has not been controverted by the petitioner as no replication and/or any further affidavit has been filed. In view of the aforesaid stand taken by the respondents, no further grounds are made out.

Dismissed.
