(ORAL) This order shall dispose of above titled both the revision petitions arising out of the same judgments passed by the Courts below. The First Appellate Court holding the petitioners guilty vide judgment of conviction dated 28.09.2016, convicted them for two years each under Section 420 IPC and to pay a fine of ` 10,000/- each vide order of sentence dated 01.10.2016 by setting aside the judgment dated 20.01.2014 of the trial Court, acquitting them. Learned counsel for both the sides by placing on record the

-2CRR-3797 of 2016 (O&M) respective affidavits of complainant Sanjeev Kumar son of Ramesh Chander and that of the petitioners Jasbir Singh and Rakesh Kumar, which are taken on record, contend that the parties have compromised the matter vide compromise deed dated 10.12.2016 (Annexure A-1). Petitioner Jasbir Singh has also filed CRM-29514 of 2017 seeking permission for compounding the offence under Section 420 IPC. Since the parties have compromised the matter vide compromise deed (Annexure A-1) and the offence under Section 420 IPC is compoundable with the permission of the Court, therefore, the application seeking to compound the aforesaid offence is allowed. Consequently, necessary permission is granted as such. Resultantly, both the revision petitions are accepted. The impugned judgment of conviction dated 28.09.2016 and order of sentence dated 01.10.2016 convicting the petitioners under Section 420 IPC are hereby set aside and the judgment of the trial Court dated 20.01.2014 is affirmed. Disposed of accordingly.
