Learned counsel for the petitioner submits that the claim of the petitioner for the grant of benefit of regularization under 2003 policy has been declined by the respondents-department on the ground that the petitioner was not the employee of the respondents-department itself, whereas in the award dated 22.01.2019 (Annexure P-1), it has already come on record that petitioner was working with the respondents- department, hence, the claim of the petitioner has been rejected by taking into consideration the incorrect facts.

Mr. Pankaj Middha, Additional Advocate General, Haryana, accepts notice on behalf of respondents-department and submits that he has instructions that the impugned order dated 14.11.2019 (Annexure P-5) may kindly be treated as withdrawn qua the petitioner with liberty to pass a fresh order by considering all the correct facts as noticed in the present writ petition within a period of eight weeks of the receipt of certified copy of this order.
