*** H.S. Grewal, J. (Oral) This is a petition for anticipatory bail filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 in case FIR No.145 dated 10.04.2025 under Sections 15(b) and 27-A of NDPS Act, 1985 registered at Police Station City Tohana, District Fatehabad. 2.
The case of the prosecution is that 11 Kg. 362 grams of poppy husk was recovered from the co-accused of the petitioner, namely Pala Ram who, during his custodial interrogation, disclosed the name of the present petitioner. There is no other case pending against the present petitioner. The petitioner is not involved in any other case and apart from the disclosure statement, there is no other evidence to implicate him for the offences mentioned in the FIR. 3.
Vide order dated 05.05.2025, this Court had directed the petitioner to appear before the Investigating Officer and join investigation and in the event of his arrest, he was ordered to be released on ad-interim bail to the satisfaction of the Investigating/Arresting Officer, subject to the conditions envisaged under Section 482(2) BNSS.

In view of the submissions of learned counsel for the petitioner especially when the petitioner having joined investigation, the order dated 05.05.2025 granting interim bail to the petitioner is made absolute. 6.
However, the petitioner shall abide by the conditions stipulated under Section 482(2) BNSS. He shall also join investigation as and when called upon to do so.

The petition stands allowed.
