Ramesh Chand v. State Of Punjab And ANR
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CRM No.M-9359 of 2017 (O&M) Date of decision: 20.03.2017 Ramesh Chand ....Petitioner
Versus
State of Punjab and another ....Respondents CORAM: HON'BLE MRS. JUSTICE REKHA MITTAL
Present:
Ms. Charu Sharma, Advocate for the petitioner.
REKHA MITTAL J. (Oral) The present petition under Section 482 of the Code of Criminal Procedure (in short 'Cr.P.C.') has been filed for quashing of FIR No.93 dated 08.09.2016 registered at Police Station Phase - 11, Mohali for offence punishable under Section 306 of the Indian Penal Code (in short 'IPC'), on the basis of compromise. Taking into consideration the nature of offence when examined in the light of Division Bench judgment of this Court "Baldev Singh vs State of Punjab and another", 2016(3) Law Herald 2020, I do not think it to be a fit case wherein intervention in exercise of jurisdiction under Section 482 Cr.P.C. can be allowed. Dismissed.
