Learned counsel states that the claim of the petitioner for grant of one advance increment on acquiring higher qualification of M.Phil w.e.f. 01.01.2006 in terms of para 7 (viii) of the notifications dated 02.09.2009 and 08.06.2011 has been rejected vide order dated 09.02.2021, Annexure P-5, without assigning any reasons by merely stating not covered by notification. He thus, prays that the matter be reconsidered, keeping in view the aforesaid notifications, in a time bound manner.

The aforesaid facts having been brought out, during the course of hearing, learned State counsel, on instructions, states that the respondents would not be averse to having a relook at the matter and decide afresh within a period of 4 months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. 3.

The matter stands disposed of accordingly and if the petitioner is found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to her interest, the same may be passed after granting opportunity of hearing to her and shall contain reasons, whereupon she shall be free to seek legal redress thereupon.
