Learned counsel for UOI refers to para Nos.6 and 7 of the affidavit dated 27.09.2024 filed on behalf of Ministry of Electronics & Information Technology, Government of India, which read thus: " 6. That based on the MHA OM, Meity, via OM No AA-18/24/2024-CSD (ANNEXURE 5), constituted a Committee on 11.07.2024 to study a mechanism to monitor and control the misuse of VPN under the Chairmanship of the Deponent with members from Group Coordinator of Cyber Security Division in Meity, representative from INTERPOL of Central Bureau of Investigation (CBI), Cyber Diplomacy
-2Division of Ministry of External Affairs (MEA), Representatives from Department of Telecommunications (DoT) and Indian Computer Emergency Response Team (I-CERT). Representatives from the Centre for Development of Telematics (C-DoT), the Indian Cyber Crime Coordination Centre (14C) of the Ministry of Home Affairs (MHA), the National Internet Exchange of India (NIXI) and the Cyber Law Division of Meity were invited to provide expert inputs. Several meetings were held by the Committee to develop a mechanism for VPN Service Providers.
7. The Committee met on 19th July, 26th July and 02nd August 2024. It examined and endorsed the recommendations mentioned in DoT's report dated 16th April 2024 and MHA's Report dated 31st May 2024. The Committee thoroughly deliberated on the use cases of VPN services in the country and attempted to understand the global best practices. It also discussed on existing ecosystem of VPNs operating within and outside India. The Committee in its meetings also explored the option of utilizing informal international law enforcement cooperation channels available with the CBI's INTERPOL division for data collection and coordination from foreign service providers, including VPN services through its missions abroad."

Learned State counsel also refers to para Nos.7 and 8 of the status report dated 04.03.2024 filed by Superintendent, Central Jail, Bathinda, which read thus:
"7. Daily search and checking is being conducted. Zero tolerance approach towards mobile/drug/prohibited article and illegal activity has shown results and there have been negligible incidents of recovery of prohibited article in the jail. Presently all attempts to smuggle prohibited articles inside the prison either through inmate coming fron. peshi (court hearing) or Mulakatis are seized in Deodi/Kot-mauka before reaching the hands of inmates inside the prison.

It is humbly submitted that illegal activities inside the prison or from the prison have been successfully curbed and continuous efforts are also being put in place to make Central Jail, Bathinda free from mobile and drug and other prohibited articles. Last recovery of mobile from any inmates was affected more than 09 months back in May 2023 and last incident of throw was attempted 06 months back in August 2023 shows the dedicated and honest efforts made by deponent and entire prison administration are showing fruitful results." 3.
In view of the above, no further orders are required to be passed.
