Challenge is to the order dated 02.02.2017 (P-5) vide which revision petition filed by respondent No. 2 was allowed and further prayer is for setting aside summoning order dated 03.11.2016. A bare perusal of order dated 02.02.2017 shows that the revision petition filed by respondent No. 2 was allowed, as it was the husband of petitioner who performed second marriage with respondent No. 2 and thus respondent No. 2 cannot be made accused as per Section 494 of IPC.

After going through the order dated 02.02.2017, it does not suffer from any illegality or infirmity.

The petition stands dismissed accordingly.
