SUVIR SEHGAL, J. (Oral) The Court has been convened through video conferencing due to Covid-19 pandemic.

Through the instant petition, the petitioner seeks anticipatory bail in case FIR No.19 dated 26.02.2020, registered under Section 21 of Mines and Minerals (Development and Regulation) Act, 1957 and Section 379 of Indian Penal Code, 1860 at Police Station City Lohian, District Ludhiana.

Learned State counsel, on instructions from SI Jaspal Singh submits that the petitioner has joined investigation and is no longer required for custodial interrogation. He further points out that the petitioner is a previous convict under the Mines and Minerals (Development and Regulation) Act, 1957.

CRM-M-26623 of 2020 {2} In view of the above facts, but without commenting on the merits of the case, the present petition is allowed and the order dated 08.09.2020 granting interim bail to the petitioner is made absolute, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure.
