This petition has been filed for grant of anticipatory bail to the petitioner in FIR No.58 dated 02.06.2015 under Sections 406/498A IPC, registered at Police Station Women Cell, Ludhiana. The petitioner had earlier gone to Dubai. He was declared a proclaimed offender. However, he had appeared before the learned trial court pursuant to orders passed in CRM No.M-9577 of 2017. The said petition was disposed of on 09.05.2017.

CRM No.M-9508 of 2017 -2Mediation and Conciliation Centre of this Court. At one point of time, it was expressed that the parties wish to resume cohabitation, but the same did not fructify. It is thereafter noted by this Court on 02.11.2017 that both the petitioner and respondent No.2 expressed their desire to part ways amicably. Respondent No.2 was earlier amenable to part ways with the petitioner, in case a sum of `10,00,000/- is handed over to her of all claims, but she reduced the amount to `6,00,000/-. The petitioner however did not agree to part with anything over and above `2,00,000/-.

The matter was adjourned on the request of learned counsel for the petitioner on two occasions thereafter. Today, learned counsel for the petitioner submits that he has instructions to withdraw this petition. Learned counsel for the State, on instructions from ASI Bhajan Singh, submits that the petitioner has in fact left the country without seeking permission from the Court.

Keeping in view the facts and circumstances as above and especially the conduct of the petitioner, this petition is dismissed. ( LISA GILL ) March 07 , 2018.
