ARUN MONGA, J. (ORAL) This is a petition for grant of anticipatory bail to the petitioner in case FIR No. 163 dated 01.08.2020 under Section 61/1/14 of the Excise Act registered at Police Station Kotwali, District Kapurthala. 2.

Per allegations, a secret information was received that petitioner along with others indulges in selling illicit liquor from his house. Accordingly, raid was conducted and co-accused Gajjan Singh was apprehended at the spot. 75000 litres of illicit liquor was also recovered. FIR was registered. 3.

Learned counsel for the petitioner contends that petitioner has been falsely implicated in the present case. He was not even apprehended at the spot. At the time when raid was conducted, the petitioner was away to village Doliwala, District Moga, at the house of his sister, which is at the distance of about 100 kms from his village. He further contends that petitioner has been involved in the present case only on the basis of disclosure statement made by co-accused Gajjan Singh. He further submits that only one plastic container SONU 2020.09.09 09:20 I attest to the accuracy and integrity of this document

with 100 bottles in it was recovered from the fields of Gajjan Singh and petitioner has no direct or indirect connection with the same. 4.

On the other hand, Ms. Rashmi Attri, AAG, Punjab, who has joined the proceedings on service of advance copy of the petition, appears and opposes bail. She contends that huge quantity of illicit liquor has been recovered. Co-accused Gajjan Singh, during interrogation has disclosed that he along with his brother (petitioner herein) were indulging in selling liquor. They used to purchase spirit from one Kulwant Singh @ Pamma and further investigation is going on.

In the premise, no ground for grant of anticipatory bail is made out, at this stage.
