Through the instant petition preferred under Section 438 Cr.P.C., petitioner has sought the pre-arrest bail, feeling apprehension of his arrest, in case bearing FIR No.40, dated May 18, 2016, under Section 452, 353, 186, 332, 333, 427, 148 & 149 IPC (Section 307 added later on), registered at Police Station Chatiwind, District Amritsar.

Undoubtedly, the previous petition preferred by the petitioner under Section 438 Cr.P.C. bearing CRM No.M-25919 of 2016 has already been dismissed on merits by this Court vide order dated August 01, 2016.

During the course of arguments, learned counsel for the petitioner could not point out any substantial change in the facts situation except that co-accused of the petitioner namely Nirmal Singh @ Nimma has preferred a petition bearing CRR No.4455 of 2016 in which notice of motion has been issued. Issuance of notice of motion does not ipso facto mean that the allegations against the petitioner are diluted. However, at the same time, learned counsel for the petitioner submits that he does not want to proceed with the instant petition in case a direction is issued to the concerned court to dispose of his application in case of he is surrender within a time bound period. 4.

The instant petition is disposed of and a direction is issued to the petitioner to surrender and apply for bail, which shall be dealt with and disposed of by the court within a period of seven days from the date of its filing.
