AMOL RATTAN SINGH, J. (ORAL) By this petition, filed under the provisions of Section 439 of the Cr.P.C., the petitioner seeks the concession of regular bail, upon FIR No.163, dated 04.04.2020, having been registered at Police Station Sonepat Sadar, District Sonepat, alleging therein the commission of an offence punishable under Sections 61/1/14 of Excise Act, 1914 and 188, 269, 270, 271 IPC (with Sections 120-B, 420, 467, 468, 471 IPC added subsequently). Learned counsel for the petitioner submits that after his petition seeking anticipatory bail was eventually dismissed by this Court, the petitioner has been in custody for seven months, with the trial still to commence, it being a magisterial trial.

Learned State Counsel does not refute that factual position but submits there are ten criminal cases registered against the petitioner and therefore he does not deserve the concession of regular bail. Learned counsel for the petitioner submits rebuts and submits that out of the ten cases, in five the petitioner was acquitted; in two cases, RENU 2021.12.08 12:13 I attest to the accuracy and integrity of this document Chandigarh

CRM-M-32282-2021 (O&M) -2he was sentenced to the period of custody already undergone by him and in two more cases, the trial is going on and he is admitted to bail. Having considered the matter, keeping in view the fact that the petitioner has been in custody for more seven months, seen with the stage of the trial, without making any comment on the actual merits of the case, the petition is allowed, with the petitioner directed to be enlarged on bail, upon his furnishing adequate bail and surety bonds to the satisfaction of the trial Court.
