IN THE HIGH COURT OF PUNJAB & HARYANA

AT CHANDIGARH CWP-14362-2022 Date of Decision: 08.01.2024 Dr. Tajbir Kaur ..... Petitioner

Versus

State of Punjab and others ..... Respondents CORAM: HON'BLE MR. JUSTICE VINOD S. BHARDWAJ

Present:

Mr.Simranjeet Singh, Advocate for the petitioner.

Mr. Yadwinder Singh, Advocate, for Mr. B.R. Mittal, Advocate for respondent No.4.

Mr. Sehajbir Singh Aulakh, AAG, Punjab.

**** VINOD S. BHARDWAJ , J.(ORAL) Prayer in the present petition is for seeking direction to respondent No.2 to decide the appeal dated 22.04.2022 filed under Section 18 of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal), Act 2013.

Learned counsel for the petitioner contends that he confines his prayer only to the extent of seeking direction to respondent No.2 - Director, Health and Family Welfare, Parivar Kalyan Bhawan, Sector 34, Chandigarh to decide the appeal preferred by the petitioner in a time bound manner. Mr. Yadwinder Singh, Advocate, for Mr. B.R. Mittal, Advocate puts in appearance by filing power of attorney on behalf of respondent No.4 and submits that he has instructions that the appeal probably has already been decided.

CWP-14362-2022 2024:PHHC:001204 Learned State counsel as well as counsel for the petitioner plead ignorance. Learned State counsel, however, has no objection in case a time bound direction to the respondent-authorities is issued to decide the appeal, if already not decided, on merits.

The present writ petition is accordingly disposed of without commenting anything on the merits of the case and with the consent of the parties, the respondent No.2 is directed to decide the appeal, if already not decided, on merits and after granting opportunity of hearing to the respective parties within a period of ten weeks from the date of receipt of certified copy of this order.
