***** GURVINDER SINGH GILL, J.(Oral) CRM-W-1004-2024 In view of the reasons mentioned in the application, the same is allowed and the hearing of the main petition is preponed from 14.11.2024 and is taken on board today.

CRWP-4928-2024 (Main Case)

1. Petitioner No.1 - Jaspreet Kaur aged about 23 years and petitioner No.2 - Maninder Singh aged about 24 years have approached this Court seeking issuance of a direction to official respondents to protect their lives and liberty as they apprehend threat to the same at the hands of private respondents, having married against the wishes of their families.

2. Notice of motion.

3. At this stage, Ms. Versha Sharma, Advocate, has today put in appearance on behalf of respondents No.4 to 10 (who are parents and relatives of petitioner

( 2 ) No.1-Jaspreet Kaur) and has filed Power of Attorney, which is taken on record.

4. Without commenting anything as regards the veracity of the averments made in the petition or as regards the validity of alleged marriage or age of the petitioners, the petition is disposed of with a direction to respondent No.2 - Senior Superintendent of Police, Fatehgarh Sahib, Punjab to look into the matter and to dispose off the representation dated 21.5.2024 (Annexure P-6) in accordance with law. In case, it is found that there is a genuine threat to the lives and liberty of the petitioners, then necessary steps warranted under law be taken thereupon at the earliest so as to ensure that no harm is caused to the petitioners.

5. A copy of this order alongwith copy of the representation dated 21.5.2024 (Annexure P-6) be sent to respondent No.2 - Senior Superintendent of Police, Fatehgarh Sahib, Punjab so as to enable him to do the needful expeditiously.

6. It is, however, clarified that the aforesaid order shall not be taken to be any expression as regards the validity of marriage or age of the petitioners and shall not confer any immunity upon the petitioners, in case it is found that they have committed any wrong.

7. Petitioner No.1-Jaspreet Kaur as well as parents of petitioner No.1 are, however, directed to appear before Secretary, District Legal Services Authority, Fatehgarh Sahib on 23.8.2024 at 10:00 A.M. The Secretary, DLSA, Fatehgarh Sahib, shall refer the parties to some seasoned Mediator, who shall try to sort out differences, if any, amongst the parties.

8. A copy of this order be also sent to Secretary, DLSA, Fatehgarh Sahib so as to enable him to do the needful.
