The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents No. 1and 2 to issue her passport.

The petitioner vide application dated 04.12.2023 has applied for passport. She was embroiled in FIR No. 101 dated 25.05.2009, under Sections 323, 324, 506, 34 of IPC, registered at Police Station Jakhal. She was convicted vide judgment dated 12.11.2014 passed by SDJM, Tohana and was awarded sentence of three years. She was released on probation vide judgment dated 27.10.2017 passed by Additional Sessions Judge, Fatehabad.

Learned counsel for the petitioner submits that she was convicted in the year 2014 i.e. more than five years back, thus, her case is squarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391. 4.

Notice of motion.

Ms. Amrita Singh, Central Government Counsel for Union of India, who on advance notice is present in Court, accepts notice and waives service.

With the consent of both sides, the petition is taken up for final disposal today itself.

Ms. Amrita Singh, Central Government Counsel submits that petitioner may be directed to appear before the passport authority alongwith requisite documents and the passport authority, thereafter, would pass an appropriate order after considering the afore-stated judgment within two months.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

In the wake of statement of both sides, the petition stands disposed of with a direction to petitioner to appear before the passport authority on 20.06.2024 alongwith requisite documents. On doing so, the passport authority would pass an appropriate order within two months from 20.06.2024.
