(ORAL) This is a petition that has been filed under Section 482 Cr.P.C. for seeking following prayers:- (i) FIR No.103 dated 17.06.2021 under Sections 323, 354, 354C, 406, 498-A, 506 IPC at Woman Police Station, District Yamuna Nagar (Annexure P-2) for investigation through Crime Branch or any other senior police officer not below the rank of S.P. or through some other investigating agency. (ii) Direction be given to take strict legal action against the accused as well as departmental action against the police official for not performing of their duty.
(iii) Direction be given to official respondent to make the list of articles (Annexure P-6) as the part of investigation, which was handed over to the respondent by the petitioner No.1. (iv) To submit the investigation report/status report in the FIR
-2and prosecute the accused persons in accordance with law, in the interest of justice.
(v) For protection of life and liberty of petitioner and his family members.
Firstly, counsel for the petitioners herein would contend that FIR No.103 dated 17.06.2021 under Sections 323, 354, 354-C, 406, 498-A, 506 IPC at Woman Police Station, District Yamuna Nagar requires to be investigated through the Crime Branch or any other senior police official, secondly would pray that direction should be given to take strict action against the accused as well as departmental action against police official for not performing their duty. The third prayer made therein is that direction be given to make list of articles (Annexure P-6) as the part of investigation, which is handed over to respondent by petitioner No.1. Furthermore, to submit investigation report/status report of FIR and prosecute the accused persons in accordance with law and for protection of life and liberty of petitioner and his family members.
Counsel for the petitioners would further contend that the accused Puneet Dhingra has entered the parental house of the complainant and subjected her and her family members to physical abuse, as would be evident from Annexure P-3/MLR.
Notice of motion.
Mr. A.S. Gill, Sr. DAG, Punjab, who is present through the medium of video conferencing accepts notice for the respondent-State and would contend that this petition with multiple prayer is not maintainable. Be that as it may, it is further submitted that the main accused in FIR No.103 dated 17.06.2021 stands arrested and that the investigation in the
-3said matter is underway. It is also submitted that FIR No.69 dated 04.05.2021 under Sections 323, 452, 506 IPC registered at Police Station Jagadhari Sadar, District Yamuna Nagar has already been registered against Puneet Dhingra in which he has been admitted to regular bail at Rs.50,000/- with one surety in the like amount, as the challan has been presented. I have heard learned counsel for the parties and considering the fact that the respondent-State is investigating the matter, no further orders are called for. Resultantly, the instant petition stands dismissed. At this stage, counsel for the petitioners seeks to withdraw the instant petition, which prayer is declined.
