*** DEEPAK GUPTA, J. (ORAL) On 30.05.2023, following order was passed:- "The prayer in the present petition filed under Section 438 Cr.P.C. is for grant of anticipatory bail to the petitioner in case bearing FIR No.0038 dated 13.03.2023, under Sections 468, 471, 420, 120-B IPC, registered at police station Sirhali, District Tarn Taran.

Learned counsel for the petitioner submits that the case in question was registered on the basis of secret information. No complaint is given by any financial institution that petitioner was indulging in getting loans on the basis of fake documents to purchase vehicles. He further submits that brother of petitioner solemnized marriage against the wishes of parents of Gagandeep Kaur and a petition bearing No. CRM-M 11902 of 2019 was filed seeking protection, which was disposed of vide order dated 14.03.2019 passed by this Court, granting liberty to them. Although, brother of the petitioner was not residing in the village but ASI Narinder Singh became inimical towards petitioner and his family at the instance of father of said Gagandeep Kaur. Father of the

 petitioner also filed petition bearing No. CRWP No.106 of 2023 (Annexure P-3) for grant of protection of life and liberty. The FIR is due to the said vendetta.

Notice of motion.

Ms. Himani Arora, AAG, Punjab, appears and accepts notice on behalf of respondent-State. A copy of the paper book be supplied to her during the course of the day.

On asking, learned State counsel submits that she has no instructions, as if any complaint has been filed by any financial institution against the petitioner regarding getting of loan on the basis of forged documents.

Adjourned to 04.09.2023.

In the meantime, petitioner is directed to appear before the SHO/Investigating Officer as and when called to join investigation and in the event of him arrest, he shall be released on bail on his furnishing bail bonds to the satisfaction of SHO/Investigating Agency, subject to the following conditions as envisaged under Section 438(2) Cr.P.C.:- (i) that the petitioner shall make himself available for interrogation before the investigating officer as and when required; (ii) that the petitioner shall not, directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case as to dissuade him from disclosing such facts to the Court or to any police officer;

(iii) that the petitioner shall not leave the country without prior permission of the Court concerned.

Status report, if any, be filed well in time with advance copy to counsel opposite.

Today, on instructions from ASI Gurdial Singh, learned State counsel has informed this Court that the petitioner has joined the investigation, in compliance of the order dated 30.05.2023 and is no longer required for further investigation.

 In view of the aforesaid, the order dated 30.05.2023, whereby the petitioner was granted interim anticipatory bail, is hereby made absolute. However, he shall continue to join investigation, if and so required by the Investigating Officer.
