(ORAL) Prayer in this petition is for issuance of directions to respondents No.1 to 3 to hand over the investigation of FIR No.484 dated 13.09.2017 under Sections 379, 420 IPC, registered at Police Station Gohana City, District Sonepat, to some other independent agency.

As per allegations in the FIR, the petitioner is maintaining an account in Punjab National Bank, Branch Gohana, District Sonepat and an ATM card bearing No.6070935002305844 was issued fraudulently in the name of some other person namely Vishant Sharma, resident of U.P. and some amount has been withdrawn from her account. It is stated in the petition that the police is not properly investigating the matter.

CRM-M-658-2018 -2Affidavit of Deputy Superintendent of Police, Gohana is on record and in this affidavit, it is stated that the investigation is being carried out in a proper manner and during the investigation, the CCTV footage of the camera installed in the ATM was obtained but the person could not be recognized due to low quality of the footage. It is further stated that with regard to identity of said Vishant Sharma, no record was found with the bank and one person namely Dalip, resident of Chhapra in Bihar was joined in the investigation but he himself was found to be victim of same fraud, as from his account also, money was fraudulently withdrawn. It is also stated that investigation is still going on.

Learned State counsel, on instructions from ASI Dal Singh, has submitted that the police, after completing the investigation, has found this case as 'not traced' and the untraceable report will be submitted before the trial Court within a period of 08 weeks from today. In view of the above, this petition is disposed of. Liberty is granted to the petitioner to approach the trial Court, if so advised.
