*** This petition for regular bail has been filed by petitioner Mangat Ram, an accused in F.I.R. No. 180 dated 9.6.2015 for offence under Sections 420,467,468,471,120-B IPC registered with Police Station Beri, District Jhajjar.
Briefly stated the facts of the case as per the prosecution story are that one Jage Ram had sold Shamlat land of Thola Brahaman in village Dubaldhan Dhikyan to Laxmi wife of accused Mangat Ram. At the time of execution of the sale deed Mangat Ram was present on behalf of his wife. The seller was not competent to sell the land since he was only a cultivator. The petitioner was arrested in this case on 30.1.2018 and presently he is in judicial custody. The challan is said to have been filed in
the court of learned Magistrate, Jhajjar and next date of hearing being 25.4.2018 for the purpose of framing of charge. Petitioner had approached the Court below for grant of regular bail but such plea was rejected as such he has knocked at the door of this Court for similar relief by filing the present petition which is being opposed the the State counsel. I have heard learned counsel for the petitioner, learned State counsel besides going through the record.
All the offences for which the petitioner has been booked are triable by the Court of learned Magistrate. Admittedly the other co-accused of the petitioner are on bail.
The trial is likely to take some time. Without going into the merits of the case, I find that it would be in fitness of things if the present petition is allowed. The petitioner is ordered to be released on bail on furnishing bail bond and surety bond to the satisfaction of the learned trial Court/CJM/Duty Magistrate, Jhajjar subject to the following conditions : - (i) he shall appear in the Court on each and every date of hearing.
(ii) he shall not give any threat or intimidation to the prosecution witnesses.
(iii) he shall not leave India without prior permission of the Court and shall surrender his Passport, if he has got one otherwise to furnish affidavit in that regard. In addition to that the trial Court may impose any term and condition found suitable to ensure that the petitioner does not abscond and interfere in the trial.
