(ORAL) In the present writ petition, the grievance which is being raised by the petitioner is that he retired from Nagar Council, Gidderbaha, District Sri Muktsar Sahib on 31.12.2018 and even after an expiry of approximately five months, no benefit for which the petitioner is entitled for after his retirement has been extended to him. Counsel for the petitioner argues that there is no impediment for the release of the pensionary benefits as no departmental enquiry or any other proceeding is pending against the petitioner, which would entitle the respondents to withhold the benefits. Counsel for the petitioner states that for the relief which has been sought in the present writ petition, the petitioner has submitted the representations (Annexures P-1 to P-4), which are still pending consideration with the respondents and the petitioner will be satisfied, at NARESH KUMAR 2019.05.31 14:40 I attest to the accuracy and integrity of this document Chandigarh
CWP-15103-2019 -2this stage, in case a time bound direction is issued to the respondents to decide his latest representation dated 09.04.2019 (Annexure P-4). In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the representation dated 09.04.2019 (Annexure P-4) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of next three months.
Present writ petition stands disposed of.
