**** ANITA CHAUDHRY, J (ORAL) Through the instant petition, the petitioner is seeking anticipatory bail in case FIR No. 138 dated 9.12.2016, registered under Sections 498-A IPC, Police Station Dina Nagar, Gurdaspur, District Gurdaspur.

Counsel for the petitioner states that pursuant to the order dated 22.3.2017, passed by this Court, the petitioner has joined the investigation. State counsel states that the petitioner has joined the investigation but three gold items i.e. rings have not been returned. Counsel for the petitioner states that all the articles and gold items were returned.

The recovery of all gold articles is disputed. The petitioner would deposit an FDR of Rs. 25,000/- in the name of the Court which Gurpreet Singh Bhatia 2018.05.16 16:32 I attest to the accuracy and authenticity of this document chandigarh

Crl. Misc. No. M-9691 of 2017 -2would be subject to the outcome of the trial. Looking to the circumstances, but without commenting on the merits of the case, the petition is allowed and order dated 22.3.2017 granting interim bail to the petitioner is made absolute subject to the conditions laid down in Section 438 Sub Section 2 Clauses (i)(ii) and (iii) of the Code of Criminal Procedure.
