(Oral) Prayer in the present writ petition is for quashing the impugned inspection report/ order dated 22.07.2021 (Annexure P-12) vide which the petitioner has been held guilty of embezzlement of funds/ fake payments and fake muster role for the construction of a Cow Ghat in Village Ugalan, Tehsil Bass, District Hisar.

The case of the petitioner is that he was posted as Assistant Block Programme Officer Hansi-II. The impugned order was passed without holding any enquiry though he was not holding any power to disburse payments, as this authority was with the Sarpanch, Gram Sachiv, Assistant Accountant and BDPO.

After hearing learned counsel for the petitioner, no ground to interfere is made out, at this stage. Writ petition has been filed pre maturely as the departmental proceedings are still at very contemplative and/or preliminary stage, if not initiated already.
