At the outset, learned State counsel, while opposing the prayer and submissions made by the counsel opposite, on instructions from SI Gurinder Singh, has submitted that the trial is nearing conclusion as all the prosecution witnesses stand examined and the next date fixed before the trial Court is 27.01.2025 for defence evidence. It has also been brought to the notice of this Court that the petitioner is a habitual offender as he is facing trial in other cases also, registered under the NDPS Act. 2.

In the wake of the stage of the trial, coupled with the recovery of heroin allegedly affected from the petitioner i.e. 280 grams of heroin, this Court does not deem it fit to extend the concession of bail to the petitioner.

Accordingly, the instant petition is hereby dismissed. However, it is made clear that anything observed hereinabove shall not be construed to be an expression of opinion on the merits of the case. At this stage, a prayer has been made by the learned counsel for the petitioner for issuing directions to the trial Court concerned to expedite the trial in view of the long incarceration of the petitioner, who has been in custody for more than 03 years, having been arrested on 24.07.2021.
