!4 15 Prayer in the instant petition filed under Article 226 of the Constitution of India, is for directing the respondents No.1 and 2 to protect the life and personal liberty of the petitioners at the hands of respondent Nos.4 to 8 who are threatening the petitioners of false implication in some false cases.

Learned counsel for the petitioners has contended that earlier respondent No.4-Ashwani Kumar, through his father was tenant in the property in dispute (shop) and did not hand over the possession of shop in question and from the last 15 years, they have shifted their business to a new place. He has further contended that respondent No.5 to 8 who are residing in the immediate neighbourhood of the petitioners, at the instance of respondent No.4 firstly broke the middle wall of the plot (i.e. the wall partitioning their residence with property of the petitioners) and they installed a door and window towards the side of their property and started Jyoti 2025.05.19 17:03 I attest to the accuracy and integrity of this document

CRWP-5109-2025 using property of the petitioners as thoroughfare. They had also installed CCTV Cameras over the property of the petitioners and when the petitioners objected regarding the same, they started threatening the petitioners. Learned counsel for the petitioners has also contended that the petitioners had also filed representation dated 02.07.2024 (Annexure P-2) before the Commissioner of Police, Amritsar, but till date no action has been taken. During the course of arguments, learned counsel for the petitioners stated that he would be satisfied, in case, the pending representation (Annexure P-2) is decided by respondent No.2. Notice of motion.

Ms. Gagandeep Kaur, DAG, Punjab, accepts notice and submitted that she has no objection if the aforesaid representation dated 02.07.2024 (Annexure P-2) is decided.

In view of the above, the petition is disposed of with a direction to respondent No.2-the Commissioner of Police, Amritsar, to look into the representation dated 02.07.2024 (Annexure P-2), at the earliest, regarding threat perception and take necessary steps, if any required, in accordance with law, to ensure that the life and liberty of the petitioner is not jeopardized at the hands of the private respondents No.4 to 8. However, it will have no effect on any civil or criminal action, which could be initiated in the matter in accordance with law.
