Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in case FIR No. 47 dated 14.08.2015, registered under Section(s) 411 & 414 IPC, Sections 21/29/61/85 of the Narcotic Drugs & Psychotropic Substances Act, 1985, Section 25/54/59 of the Arms Act, 1959 and Section 3 of the Official Secrets Act, 1923 at Police Station Khem Karan, District Tarn Taran.
Learned counsel for the petitioner contended that petitioner be admitted to fresh bail as earlier he was admitted to bail and was regularly appearing before the learned trial Court. However, on 25.04.2019, because of medical problem, petitioner could not appear before the learned trial Court and his bail was cancelled. Now, petitioner is ready to surrender before the learned trial Judge and furnish fresh bail bonds to his satisfaction. Notice of motion.

Criminal Misc. No. M-25055 of 2019 Advocate General, Punjab accepts notice on behalf of respondent. A copy of paper-book be provided to him during the course of the day. In view of above, present petition stands disposed of with the directions that in case petitioner surrenders before the learned trial Court within a period of one week from today and moves an application for admitting him to bail, the learned trial Judge shall release him on bail on his furnishing fresh bail bonds and surety bonds to his satisfaction. However, the learned trial Judge shall be at liberty to complete the proceedings under Section 446 Cr.P.C. against the petitioner.
