******* SURINDER GUPTA, J.(Oral) This is second petition under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No. 134 dated 07.07.2017 registered for the offences punishable under Sections 394/34 of Indian Penal Code (for short, "IPC") at Police Station Model Town, Ludhiana. {Offences punishable under Sections 411/148/149 IPC were added later on and challan under Section 173 Cr.P.C. was presented for offences under Sections 395/397/411/148/149 IPC (Section 394/34 were deleted later on)}.

Heard.

The petitioner sought bail for offences punishable under Sections 394/411/148/149 IPC, which was allowed vide order dated 04.12.2017. His co-accused Vivek Kumar also applied bail under similar sections but later on it was noticed that challan had been presented for offences punishable under Sections 395/397/411/148/149 IPC and offences under Sections 394/34 IPC has been deleted by the police. CRM-M-6693 of 2018 -2was allowed regular bail vide order dated 17.11.2017. Learned State counsel on instructions from HC Mewa Singh submits that allegations against co-accused Vivek Kumar and petitioner are similar.

Without expressing any opinion on merits of the case and keeping in view the fact that conclusion of trial will take considerably long time, the present petition is allowed. Petitioner-Anurudh @ Prince is ordered to be released on regular bail on furnishing bail bond and surety bond to the satisfaction of concerned trial Court/Chief Judicial Magistrate/Duty Magistrate, subject to following terms:- (a) The petitioner shall comply with the conditions mentioned in Section 437(3) Cr.P.C.

(b) In the event of his absence on any date of hearing, the benefit of bail allowed to the petitioner shall stand withdrawn. The trial Court shall be competent to cancel his bail bond and surety bond and proceed to procure his presence in accordance with law. In that eventuality the petitioner shall have to apply for bail afresh. (c) He shall not leave the country without the previous permission of the Court.
