CM No. 1935-LPA- 2023 For the reasons mentioned in the application, delay of 41 days in filing the appeal is condoned. Application stands disposed of. LPA No. 748 of 2023 (O&M) The appellant has challenged the impugned judgment dated 15.03.2023 passed by the learned Single Judge only on the ground that the after calculating the total marks of educational qualification and physical measurement, which is 5'10.75", the appellant secured 26 marks in the written examination but despite that he has not been called for interview for the post of Jail Warder.

On the other hand, learned Deputy Advocate General appearing for the respondent-State has made a reference to para No.2 of the written statement at page 351 and submits that the petitioner had secured 23 marks after re-measurement and re-checking of the educational qualification and the cut of marks of Scheduled caste-other category had been fixed at 24 for qualifying in interview. Hence, the appellant was below the fixed cut of marks of his category and accordingly, we do not find any merit in the contention raised by learned counsel for the appellant and the impugned judgment passed by the learned Single Judge does not warrant any interference. The appeal is accordingly dismissed.
