******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 3 dated 02.01.2017 registered for the offences punishable under Sections 379, 406, 420 of Indian Penal Code (for short IPC) (Sections 379-A, 170, 506, 120-B read with Section 34 IPC added later on) at Police Station DLF II, Gurgaon (Now Gurugram).

Heard.

The matter has since been amicably settled, under which, the petitioner had to pay remaining balance amount of `3,70,000/- in monthly installments of `45,000/-.

In view of said settlement between the parties, this petition is allowed and the order dated 11.07.2017 is made absolute till the presentation of challan, subject to the following terms:- Jyoti 2018.05.17 17:26 I attest to the accuracy and authenticity of this document

CRM-M-9810-2017 -2- (i) that the petitioner will deposit the amount of `45,000/- in the account of complainant on or before 20th of each month. The first installment shall be payable on or before 20th June, 2018. She will keep on paying monthly installments till the entire amount is duly paid. (ii) learned counsel for the complainant/respondent will supply the bank account number of complainant to learned counsel for the petitioner. In case, bank account number of complainant is not supplied, the petitioner will deposit the said amount before the trial Court for payment to the complainant. In default of payment/deposit of any of the installment on or before the date fixed, concession of bail allowed to her shall stand withdrawn automatically.

(iii) that the petitioner shall make herself available for interrogation by the police as and when required; (iv) that the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against her so as to dissuade him from disclosing such facts to the Court or to any police officer;

(v) that the petitioner shall not leave India without the prior permission of the Court.

(vi) that the petitioner will seek regular bail on the presentation of challan in Court.
