Rajan Gupta, J (Oral) Petitioner is aggrieved by the order passed by Additional Sessions Judge, Rohtak whereby his application for release of articles on superdari has been partly allowed.
Prayer has been opposed by learned State counsel on the ground that petitioner did not present the proper documents of the car in question. Thus, same could not be released by the court. Keeping in view the facts and circumstances of the case, I feel that petitioner needs to be relegated to the same forum for consideration of his case afresh. Counsel for the petitioner undertakes that he shall present the proper documents before the concerned court to seek release of remaining articles including the car. It is directed that in case any fresh application is moved by the petitioner for release of his car, same shall be considered by the court in accordance with law. The order in so far as it declines release of vehicle is hereby set-aside. (Rajan Gupta) Judge August 18, 2015 BB
