HON'BLE MR. JUSTICE H.S. MADAAN Present:- Mr. Aakash Juneja, Advocate for the petitioner. *** The case has been taken up through Video Conferencing. The grouse of petitioner Ramdass Chela Baba Jagram Dass Chela Baldev Dass is that Civil Appeal filed by him way back in March, 2017 with service being complete as recorded in interim order of the Appellate Court dated 20.12.2017 (Annexure A1) and lower Court record having been received as is clear from copy of interim order of Appellate Court dated 9.5.2018 (Annexure P2), the case is being adjourned quite frequently and has not been taken up for final disposal so far. A perusal of the other interim orders placed on record by the petitioner-appellant goes to show that the appeal is being adjourned from time to time for various reasons including breaking out of Covid-19 pandemic.

Though Appellate Court cannot be solely held responsible for frequent adjournments granted in the appeal but then expeditious trial is right of every litigant, especially of a Senior Citizen. The petitioner appellant is stated to be aged about 67 PARVINDER SINGH 2021.08.

Civil Revision No. 1628 of 2021 years, as such a Senior Citizen.

Accordingly, this petition under Article 227 of the Constitution of India filed by petitioner-appellant is disposed of directing the First Appellate Court to hear and dispose of the appeal expeditiously preferably within a period of six months from the date of receipt of copy of this order in the said Court.
